The Office of the Clerk of the Circuit Court is established by Article 8, Section 9 of the West Virginia Constitution. Circuit Clerk are elected for a period of six years and their duties, responsiblitlies and compensation are set by statute.                                                                                                                   

The Circit Clerk is an officer within the Judicial System, and is the registar, recorder and custodian of all pleadings, documents and funds pertaining to cases filed in Circuit and Family Courts.                   

Some of the types of cases handled are civil actions, domestic relations, adoptions, mental hygiene cases, guardianships, juvenile cases, appeals from Magistrate Court, criminal cases, and miscellaneous cases. Many of the cases are public record. However, others are confidential; these include adoptions, mental hygiene cases, guardianships and juvenile cases. Domestic relations cases are also restricted in some ways.
